Terms and Conditions

As the legal parent and/or guardian of the Child (referred to as "Parent," "I," or "me"), you give your consent for your Child to participate in the activities and programs (the "Program(s)") organized by 3Kinnect Science & Technology Centre, including all related events.

Program Classification

1. Regular Classes / Monthly Membership

The membership program is offered 1, 3, or 5 days per week, depending on the parent's enrollment. Each session varies from 1 to 2 hours depending on the program type.

Payment Terms:

After completing the online purchase and making payment in full, the subscription plan will begin immediately and will be valid for one month. The subscription plan will automatically be renewed every month and charged to the customer's credit card on file.

Rescheduling Policy:

To reschedule a session, notice must be provided at least 12 hours in advance. Rescheduled sessions must be completed within 14 days of the original class date.

If an individual session of the Program must be cancelled due to a school closure unrelated to COVID-19 (e.g., weather-related, "snow day"), 3Kinnect Science & Technology Centre will provide a make-up class. No credit or refund will be offered in this case.

Cancellation Policy:

Fourteen (14) days' written notice is required for cancellation of the subscription plan. Memberships may be frozen for up to three (3) months total within a calendar year.

2. After-School STEM Club

The After-School STEM Club program offers part-time and full-time enrollment options with daily STEM activities, homework support, and tutoring.

Payment Terms:

Monthly fees are based on the selected enrollment option and program frequency (1, 3, or 5 days per week). Payment is due at the beginning of each month.

Cancellation Policy:

Fourteen (14) days' written notice is required for cancellation. No refunds will be issued for partial months.

3. Camps

The camp program is described as spring camp, winter camp, or Pro-D Day camp, depending on the parent's enrollment.

Payment Terms:

The program price is established at the time of registration, and the Parent agrees to pay the full amount as specified during registration.

Cancellation & Refund Policy:

• Before 3 Weeks: Cancellations made at least 3 weeks before the camp start date are eligible for a full refund.
• Before 2 Weeks: Cancellations made between 2 and 3 weeks before the camp start date will receive a full refund minus a $50 administrative fee.
• Within 14 Days: No refunds will be issued for cancellations made within 14 days of the camp start date.
• Once Camp Starts: No refunds will be issued after the camp has begun.
• Transfer Option: Depending on availability, you can have the option to transfer your registration to a different camp session.

General Policies

Photo, Image and Video Policy

3Kinnect Science & Technology Centre occasionally captures photos and short video clips during classes to highlight student projects and promote our programs through newsletters, social media, and our website.

• By registering for the program, you grant permission for your child to be photographed or recorded during class activities.
• These materials will be used only for promotional and educational purposes by 3Kinnect Science & Technology Centre.
• We do not include names or identifying personal information without explicit consent.
• If you do not wish for your child to appear in any photos or videos, please indicate this during registration or notify us in writing at [email protected].

Video Surveillance

You understand and agree that 3Kinnect Science & Technology Centre may utilize video surveillance equipment to monitor both the interior and exterior areas of its premises 24/7. By participating in the Program(s), you acknowledge that both your child and you may be recorded under this video surveillance. However, no video surveillance will be conducted within the bathrooms.

Attendance Policy

You understand and agree to deliver the Child directly to 3Kinnect Science & Technology Centre's staff member and do not remove the Child from 3Kinnect Science & Technology Centre premises without direct communication with, and acknowledgement from, a staff member. Parents or guardians are welcome but not obligated to remain on the premises during a student's scheduled session. Students will only be allowed to leave the facility when accompanied by an authorized parent or guardian.

Code of Conduct & Anti-Bullying Policy

By enrolling in 3Kinnect Science & Technology Centre's Program(s), you agree that your child must follow the Code of Conduct to ensure a safe and positive learning environment. This includes respecting instructors, peers, and property, following instructions, and using appropriate language and behaviour.

Anti-Bullying Policy:

3Kinnect has a zero-tolerance policy for bullying, including:

• Verbal (name-calling, insults, offensive jokes)
• Physical (pushing, hitting, unwanted contact)
• Cyberbullying (spreading harmful content, online harassment)
• Exclusion or intimidation (isolating or threatening others)

Violations will result in disciplinary actions such as verbal/written warnings, suspension, or dismissal.

Disciplinary Actions & No Refund Policy:

Failure to comply may lead to warnings, suspension, or permanent dismissal. If dismissed, no refunds will be issued. By enrolling, you acknowledge and agree to these terms.

Health and Medical Emergency Authorization

We will notify the parent/guardian when the child feels ill or needs medical attention. In the event of a medical emergency involving your child, you authorize 3Kinnect Science & Technology Centre staff to:

• Administer basic first aid
• Contact emergency medical services (911)
• Transport your child to the nearest appropriate medical facility
• Consent to emergency medical examination and treatment, including but not limited to X-rays, routine tests, anesthesia, surgery, or other procedures deemed necessary by licensed medical personnel
• Make medical decisions on your behalf if you cannot be reached and immediate treatment is required to prevent serious harm or death

You acknowledge that 3Kinnect staff are not medical professionals and will use reasonable judgment in emergency situations. You agree to be solely responsible for all costs associated with emergency medical treatment, including ambulance transport, emergency room fees, and follow-up care. You agree to provide accurate emergency contact information and to keep such information current. This authorization remains in effect for the duration of your child's enrollment in 3Kinnect programs unless you revoke it in writing.

Informed Consent and Assumption of Risk

You confirm and warrant to 3Kinnect Science & Technology Centre that you have disclosed all accurate and complete information requested related to the child, including the child's age and any behavioural, physical, or mental health conditions. The child does not have any behavioural, physical (including major allergies) or mental health conditions that could affect his or her ability to participate in the activity or that would involve health or safety risks to other participants, the public, any third party or him/herself. If any such conditions exist, you waive any claims against 3Kinnect Science & Technology Centre arising in respect of such conditions.

You understand that 3Kinnect Science & Technology Centre may rely upon such information, and you confirm that such information is accurate and complete. You understand that failure to disclose necessary or relevant information related to the child, including any such behavioural, physical, or mental conditions, may result in the immediate withdrawal of the child from the Activity.

The activities offered as part of the program include but are not limited to the use of professional tools, materials, and equipment for designing, modeling, and constructing different projects. While these activities and projects offer educational and enjoyment benefits to the student, such as developing critical thinking, problem-solving, logical, communication skills, and self-confidence, there are risks associated with them. Although 3Kinnect Science & Technology Centre attempts to minimize the risks, as the parent/guardian, you understand and agree that there are possible injuries, including but not limited to physical injury. You consent to the student's participation despite such risks.

You acknowledge and agree that 3Kinnect Science & Technology Centre cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Instead, services shall be executed in a professional manner and in accordance with good industry and education practices. Best efforts will be made, but no results are promised.

Liability Release and Waiver

You acknowledge that participation in 3Kinnect programs involves inherent risks, including but not limited to: cuts, burns, bruises, sprains, allergic reactions, equipment malfunction, slips and falls, and other injuries that may occur despite reasonable safety precautions. You voluntarily assume all such risks on behalf of your child.

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue 3Kinnect Science & Technology Centre, its directors, officers, employees, volunteers, agents, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by your child or you, whether caused by the ordinary negligence of the Released Parties or otherwise, while participating in such programs or while on the premises.

This release does not apply to claims arising from gross negligence, willful misconduct, or intentional torts by the Released Parties. You understand that gross negligence means a marked departure from the standard of care that a reasonable person would observe in the situation.

You agree not to sue and understand that if you or your successors file a claim contrary to this agreement, you will be responsible for all legal fees and costs incurred by 3Kinnect Science & Technology Centre in defending such claim, unless the Released Parties are found liable for gross negligence or willful misconduct.

This agreement represents the full understanding between the parties and applies to all past, present, and future claims, whether known or unknown. It covers all types of damages, including compensatory, contractual, statutory, and warranty-related losses. By registering, you acknowledge that you fully understand and accept these terms.

Indemnification

You agree to indemnify, defend, and hold harmless 3Kinnect Science & Technology Centre, its directors, officers, employees, volunteers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to: (a) your child's violation of these Terms and Conditions; (b) your child's violation of any third-party rights, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; (c) your child's conduct or behavior during program participation; (d) any misrepresentation made by you; or (e) your breach of any representations, warranties, or obligations under this Agreement.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be instituted exclusively in the courts of British Columbia sitting in Abbotsford or Vancouver, and each party irrevocably submits to the exclusive jurisdiction of such courts.

Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from this Agreement. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby, and shall continue in full force and effect.

Force Majeure

3Kinnect Science & Technology Centre shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, epidemics, pandemics, government orders or restrictions, public health emergencies, fire, flood, earthquake, labor disputes, utility failures, equipment failures, or facility damage (collectively, "Force Majeure Events").

In the event of a Force Majeure Event, 3Kinnect may, at its sole discretion: (a) suspend program operations temporarily; (b) transition to virtual/online programming; (c) reschedule sessions; or (d) cancel programs. If programs are suspended for more than 30 consecutive days, you may request a pro-rated refund for unused sessions, or you may elect to receive a credit toward future programs. 3Kinnect shall not be obligated to provide refunds for Force Majeure Events lasting less than 30 days.

Entire Agreement

This Agreement, together with the Privacy Policy and any program-specific enrollment forms, constitutes the entire agreement between you and 3Kinnect Science & Technology Centre regarding your child's participation in programs. This Agreement supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding such subject matter.

Acknowledgment and Certification

By registering for programs at 3Kinnect Science & Technology Centre, you confirm and warrant that you:

• Are the parent or legal guardian of the Child and have full authority to agree to this Agreement.
• Have had sufficient time to review this Agreement and have read it in its entirety.
• Fully understand and voluntarily accept all terms outlined in this Agreement.
• Are signing this Agreement willingly, without any pressure or obligation.
• Have not been influenced or misled by any statements or actions of 3Kinnect Science & Technology Centre.
• Possess the mental competency and legal capacity to enter into this Agreement on behalf of yourself and your Child.
• Are over the age of 18.
